Revisiting the Pay Transparency Directive
Here are some quick points about the directive which should catch your attention:
1. This is not a distant EU regulation — it will become Maltese law by June 2026.
All employers, regardless of size or past complaints, will be affected. National legislation is on its way.
2. Pay transparency will shift from ‘best practice’ to legal requirement.
Employers will need to disclose salary ranges in job adverts, respond to employee pay queries, and prove equal pay for work of equal value.
3. Gender pay gap reporting is only part of the picture.
The real challenge lies in documenting how pay decisions are made and ensuring your processes are objective, consistent, and defensible.
4. You can’t comply without structure, job evaluation is key.
The Directive implicitly requires a gender-neutral job evaluation system. If you don’t have one, it’s time to speak to us.
5. Non-compliance has real consequences.
Think reputational damage, legal liability, exclusion from public procurement, and unlimited compensation claims.
